Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PeakStack website (the "Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Who we are

PeakStack is a software development studio operated by Khoury Digital LLC, a limited liability company registered in Wyoming, USA ("PeakStack," "we," "us"). We design and build web and mobile software for our clients. Any project we take on is governed by a separate, signed agreement (a proposal, statement of work, and/or master services agreement). Nothing on this Site creates a client relationship, a contract, or an offer to perform work.

2. Informational only — no guarantee

Content on the Site is provided for general information about our services. It is not professional, legal, or technical advice, and descriptions of past or current work are illustrative only. Do not act on Site content without a formal engagement or qualified professional advice.

3. Acceptable use & prohibited activities

You agree not to, and not to attempt to:

• access, or attempt to access, any non-public area, account, or data, or bypass any authentication or access control on the Site;
• scan, probe, penetration-test, fuzz, or otherwise security-test the Site or its infrastructure without our prior written authorization;
• upload or transmit malware, malicious code, or harmful scripts, or disrupt the Site (including denial-of-service);
• scrape, harvest, or misuse content or personal data; or
• use the Site for any unlawful purpose.

4. Intellectual property

The Site, its content, and the PeakStack name and marks are owned by us or our licensors. You may not copy, modify, or redistribute them without permission, except as allowed by law. Ownership of work product created during a client engagement is governed by that engagement's signed agreement — as a rule, our clients own the software we build for them on delivery and payment.

5. Limitation of liability

To the maximum extent permitted by law, PeakStack is not liable for any indirect, incidental, consequential, special, or exemplary damages (including lost profits, data, or goodwill) arising from your use of the Site. The Site is provided "as is" and "as available" without warranties of any kind.

6. Indemnification

You agree to indemnify and hold PeakStack harmless from claims arising out of your use of the Site or your breach of these Terms.

7. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the courts or by arbitration seated in that jurisdiction.

8. Changes

We may update these Terms from time to time; the "Last updated" date reflects the latest version. Continued use of the Site means you accept the changes.
